Priority debts - not paying this type of debt could cause you to lose something, such as your home or your freedom
Non-priority debts - not paying this type of debt is unlikely to lose you any possessions but can still lead to court action
Table of priority debts:
| Debt | Result of not paying |
|---|---|
| Rent or mortgage | Loss of home |
| Secured loan | Loss of home or other item |
| Council tax | Bailiffs, imprisonment |
| Income tax or VAT arrears | Bankruptcy or imprisonment |
| Fines - such as driving offences | Bailiffs, imprisonment |
| Maintenance or child support | Bailiffs, imprisonment |
| Fuel - gas/electricity | Disconnection of supply |
| Hire purchase (car) | Loss of item - car |
Non- priority debts include
- credit cards and store cards
- catalogue debts
- overdrafts and bank loans
- overpayment of benefits
- money owed to family and friends
- loans to money lenders
You cannot be imprisoned for not paying non priority debts and you are unlikely to lose you home or goods. However, creditors can take you to court. The court may then order you to pay. If you do not keep up with the order, the creditor can apply for another court order to send the bailiffs.
Payments to non-priority creditors can be reduced to as little as £1 per month if your income is low but you may need help to get this in place.
